Terms of Service

These Terms of Service (“Terms”) govern your use of the DesignThisSite website and services at designthissite.com. By using our service, you agree to these Terms.

1. Service Description

DesignThisSite provides AI-assisted website design and development services. We offer a free consultation tool that generates custom website designs based on your input, and paid services to deliver complete WordPress websites with hosting.

2. Free Consultation

The AI design consultation and initial layout previews are provided free of charge with no obligation. You are not required to place an order after using the consultation. Designs generated during the free consultation are previews and may differ from the final delivered product.

3. Annual Plan

The annual plan includes a custom WordPress website, domain registration, hosting, SSL certificate, business email, ongoing maintenance and technical updates, backups, security monitoring, and support. The service is billed annually. You can cancel anytime — your site stays active until the end of your paid yearly period.

4. Payment

Payment is due upon direct online payment. The full amount of the annual order is to be paid via checkout before delivery. The prices are presented in different local currencies (Euros, US Dollars, Pounds Sterling) and taxing follows the EU laws. The prices do not include tax. The tax will be added:

• 25,5% VAT for orders from Finland
• 0 % for orders from business with valid VAT number from other EU countries
• Local VAT for orders from other EU countries without business VAT number
• 0 % tax outside EU

5. Ownership & Intellectual Property

5.1 Your Child Theme Upon full payment, you own the custom child theme files delivered to you — including all customizations, style choices, layout configurations, and content specific to your site. You may modify, host, and use your website as you see fit.

5.2 Our Base Theme & Platform The underlying DesignThisSite base theme, platform, AI consultation system, and associated tooling remain the sole intellectual property of DesignThisSite / Verkkovaraani Oy. Your child theme is built upon and requires our base theme to function. We grant you a perpetual, non-exclusive, non-transferable license to use the base theme solely as the technical foundation of your delivered website. You may not extract, redistribute, resell, or use the base theme independently of your delivered child theme.

5.3 Stock Assets Any stock images, icons, or third-party assets incorporated into your design remain subject to their respective license terms. We will inform you of any asset-specific restrictions at the time of delivery.

6. Cancellation & Data Export

You may cancel the annual plan anytime. The money you have paid will not be returned and the order will be ended at the end of the order period. You can install any WordPress backup plugin into your website and use that to make a complete export of your website — theme files, content, images, and database backup. Your domain can be transferred to another registrar at your request. We retain the right to delete your hosting data 30 days after the end of your last paid period.

7. Refund Policy

Since the consultation and initial design are free, and you see the design before purchasing, we do not offer refunds on delivered websites. If you are dissatisfied with the delivered result, contact us and we will make reasonable efforts to address your concerns. Annual plan payments that have already been billed are non-refundable.

8. Service Availability

We strive to keep our website and hosted client websites available at all times. However, we do not guarantee 100% uptime. Scheduled maintenance, technical issues, and circumstances beyond our control may cause temporary interruptions. We are not liable for damages arising from service interruptions.

9. AI-Generated Content

Website designs and content are generated using artificial intelligence. While we strive for accuracy and quality, AI-generated content may contain errors or inaccuracies. We make our own quality control, but you are responsible for reviewing and approving all content before your website goes live. We recommend verifying any factual claims, contact information, and business details. Also, AI-generated content is not protected under IPR laws.

10. Portfolio & Reference Rights

We reserve the right to display your completed website — including screenshots, live previews, and design details — in our portfolio, case studies, marketing materials, and on our website, for the purpose of showcasing our work. This applies to all projects, whether delivered under a free or paid plan. This also applies to the generated layout suggestions which have been generated during our free consultation. We will not disclose any confidential business information in connection with such displays. You may opt out of portfolio use at any time by notifying us in writing.

11. Acceptable Use

You agree not to use our service to create websites that contain illegal content, promote violence or hate, infringe on intellectual property rights, distribute malware, or engage in spam or phishing. We reserve the right to refuse or terminate service for websites that violate these terms.

12. Limitation of Liability

To the maximum extent permitted by Finnish law, our total liability for any claims arising from the use of our service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits, data loss, or business interruption.

13. Governing Law

These Terms are governed by the laws of Finland. Any disputes arising from these Terms shall be resolved in the courts of Finland. EU consumers retain rights under their local consumer protection laws where applicable.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. For active annual plan subscribers, we will provide 30 days’ notice of material changes by email. Continued use of our service constitutes acceptance of the updated Terms.
